Terms of Use
1. Presentation
1.1 Keep Nomad and all content contained therein are the exclusive property of I.I.C.N.Da Gama Filho, a private legal entity, registered under CNPJ nº 29.237.191/0001-91, with its head office at Rua Diogo Rodrigues Marques, 353 – São Paulo – SP – 04677-042.
1.2 The rules set forth in these Terms of Use govern the services offered on the website www.keepnomad.com.
1.3 These Terms of Use and the Privacy Policy comply with the principles of Article 6 of Law 13.709/2018 – General Data Protection Law (LGPD) and, therefore, constitute a duty of the data controller and a right of the personal data subject.
1.4 The User is not entitled to copy or record, in whole or in part, the digital content made available, under penalty of incurring the crime of violation of copyright.
1.5 The User voluntarily agrees that, in all circumstances related to the training provided by Keep Nomad, their rights are limited by copyright and/or intellectual property laws, as set out in the clauses above.
2. User Permissions
2.1 By accepting these Terms of Use, the User is granted a non-exclusive, non-transferable, non-sublicensable and limited right to access and use the training, through the subscription of the Keep Nomad annual plan, as advertised on the course sales page (www.keepnomad.com).
2.2 Any rights not expressly granted in writing in these Terms are reserved to Keep Nomad.
2.3 Full access to the training is granted through an account registered on the Keep Nomad platform. The account is personal and non-transferable and therefore cannot be assigned to anyone other than the purchaser under any circumstances.
2.4 The User is not entitled to copy or record, in whole or in part, the digital content made available, under penalty of incurring the crime of violation of copyright.
2.5 The User voluntarily agrees that, in all circumstances related to the training provided by Keep Nomad, their rights are limited by copyright and/or intellectual property laws, as set out in the clauses above.
3. Service Description
3.1 Access to the training is complete, as well as to all content offered to subscribers of the Keep Nomad annual plan.
3.2 The purchase of the Keep Nomad annual subscription grants the User access to the training and other courses made available to annual subscribers of the Keep Nomad platform.
3.3 Access to the training will be available for the period during which the User remains a subscriber of the Keep Nomad annual plan.
3.4 The Keep Nomad annual plan subscription may be purchased under the following payment methods:
a) Payment via Boleto (bank slip): By choosing this method, a boleto will be generated and the full course price for access will be charged in a single payment.
b) Payment via Credit Card: By choosing this method, the full course price for access will be charged to the User’s credit card.
c) Installment Payment via Credit Card: By choosing this method, the full course price for access will be charged to the User’s credit card in between 2 (two) and 12 (twelve) fixed, equal and consecutive installments, depending on the User’s choice.
d) Payment via Pix: By choosing this method, a code and/or QR Code will be generated and the full course price for access will be charged in a single payment.
4. Promotions
4.1 Whenever it deems appropriate, Keep Nomad may run promotions related to the training, with or without specific restrictions, which will be advertised according to the company’s interests.
4.2 Participation in any promotions implies acceptance of the specific rules applicable to each promotion.
5. Use of the Account
5.1 The User agrees that only they will use their account in the members’ area of the Keep Nomad platform, and that they will not transfer it to any third party, nor share or make available the digital content provided, under penalty of incurring civil and criminal sanctions for violation of copyright, which is the exclusive property of Keep Nomad.
5.2 The User agrees to notify Keep Nomad through the platform channels if any breach of their account occurs.
5.3 The User acknowledges and agrees that the data provided at the time of purchase of the Keep Nomad annual subscription will appear on the invoice (Nota Fiscal) for the course purchase.
5.4 The User will have a non-extendable period of 5 (five) days to correct any errors in the personal information provided at the time of purchase of the annual plan subscription on the Keep Nomad platform.
6. Policies and Rules
6.1 By accessing the members’ area and all Keep Nomad content, including the training, the User will be subject to all rules described in these Terms of Use, which may be modified at any time.
6.2 Keep Nomad monitors activities on its platform. Thus, a unique system identification may be created to ensure security and prevent fraud.
6.3 The minimum age for purchasing and using the Keep Nomad annual subscription and for participating in promotions and offers is 13 years. Users under 16 years of age must be represented by their parents or legal guardian at the time of course purchase. Users over 16 and under 18 years of age must be assisted by their parents or legal guardian at the time of course purchase.
6.4 The User agrees that violating these Terms of Use may result in the User being banned without any right to refunds and/or any deduction or compensation for damages.
6.5 The User agrees that anonymity is prohibited within the Facebook community and that they will provide true information for registration, if requested by Keep Nomad for any specific need.
6.6 The User agrees that the data provided at the time of registration for the purchase of the Keep Nomad annual plan subscription will appear on the invoice for the subscription purchase and that there will be no possibility of changing the invoice after it has been issued.
6.7 As access is personal and non-transferable, it is forbidden to encourage others to violate this rule.
6.8 The resale, transfer, exchange and similar activities involving the content of the training are expressly prohibited.
6.9 No training content may be transferred, passed on, assigned, commercialized, supplied, displayed for sale or offered, even free of charge, to third parties without prior express authorization from Keep Nomad.
7. Use of the Training on the Keep Nomad Platform
7.1 The rights set forth in these Terms of Use do not grant any of the following rights:
a) Entering into agreements with any profit-generating transmission system (terrestrial, satellite, cable and/or other distribution channels);
b) Distributing to third parties the didactic content of the training in other content distribution systems (paid audio applications, audio on demand or similar) or in physical media (Compact Disc, Digital Versatile Disc, semiconductor chips, hard drives, memory cards and similar);
c) Reproduction or promotional use of the training content;
d) Distributing or redistributing the didactic content of the training in streaming applications (via Internet, intranets and/or other networks);
e) Commercial, sales, resale, reproduction, distribution or promotional use of the training content.
7.2 If the User is authorized to possess or control the didactic content of the training, it will be their responsibility not to lose, damage or destroy it.
8. Refunds
8.1 Unless otherwise expressly stated in writing, there will be no refunds and/or cancellations. These Terms of Use, as well as the Terms of Use and Privacy Policy of the Keep Nomad platform, will come into effect from the User’s acceptance and from payment confirmation and release of access to the platform.
9. Termination
9.1 Keep Nomad reserves the right to terminate the User’s account and prevent their access at any time, if any violation of any clauses of these Terms of Use is identified.
9.2 If the User’s account is terminated as described above, no fee or expense will be refundable.
9.3 No expenses are refundable. Upon acquiring access, the User may enjoy it throughout the contracted period.
9.4 Any loss of the User’s right of access to the Keep Nomad platform, whether due to cancellation, non-payment of the bank slip (boleto), the User’s exclusive fault, among others, will result in the loss of access to any functionalities and additional services, if any.
10. Right of Withdrawal
10.1 In compliance with the Brazilian Consumer Defense Code, the User may, within 7 (seven) days from the date of purchase, request cancellation with full refund of the amounts paid, by sending a request via email to [email protected].
10.2 Keep Nomad will refund any amounts paid within 2 (two) business days.
10.3 In the case of purchases made by credit card, Keep Nomad will immediately inform the payment gateway in order to process the reversal (chargeback) of the charges, and its effective completion will be the exclusive responsibility of the payment gateway, since Keep Nomad has no control over such procedures.
10.4 Cancellation requests made after the 7 (seven) day period will follow the guidelines defined in the Keep Nomad platform Terms of Use (https://keepnomad.com/termos-de-uso/), item 13 (Cancellation of the annual plan).
11. Payments and Credit Card Transactions
11.1 To process payment where the User contracts a paid Service, we will share their credit card number, bank details, billing data and contact information with financial institutions, payment method providers, payment integrators and credit card companies.
11.2 When registering their credit card, a charge in the amount of $1.00 may be made to validate the credit card with the card issuer. The amount charged will be refunded within a period of up to 72 hours.
11.3 The User agrees that all fees and sales taxes and any other expenses incurred in connection with the use of Keep Nomad may be charged to their credit card.
11.4 All expenses will be billed to the User’s credit card, according to the payment method chosen on our platform. Any fees or bank charges arising from the contract herein shall be the User’s responsibility.
11.5 After the contracted period of the annual subscription has elapsed, the User’s access will be automatically renewed. The User agrees that the amounts arising from the renewal will be debited and undertakes to maintain the necessary funds for payment at the appropriate time.
11.6 The User agrees that they are responsible for keeping their payment information up to date.
11.7 By providing their credit card information to Keep Nomad, the User agrees that they will review the terms and conditions imposed by the credit card issuer regarding requirements and limitations of notification on their responsibility in case of loss, theft or unauthorized use of the card, as well as information related to the credit limit and use thereof.
11.8 The User agrees that they will be solely responsible for payment of all billed amounts. The User agrees that they will not provide any credit card information that is not in their own name.
12. Privacy
12.1 By registering and purchasing the annual subscription of the Keep Nomad platform, the User agrees to comply with its Terms of Use (https://keepnomad.com/termos-de-uso/).
13. Changes to the Terms of Use
13.1 Keep Nomad may change these Terms of Use at any time. When changes occur, Keep Nomad will notify the User via email, requesting a new expression of agreement to the Terms of Use.
13.2 By continuing to access the content after notification of the changes to the Terms of Use, Keep Nomad will understand and consider such conduct as consent to the newly published version of the Terms of Use.
14. Digital Content
14.1 Any training content may be modified, removed, moved, reorganized, re-recorded, re-edited and merged with other content by Keep Nomad or specifically by any third party it authorizes.
15. Copyright
15.1 All content made available in the training is protected by applicable copyright laws and treaties.
15.2 Except as provided in these Terms, no User is allowed to dispose of, modify or commercialize the training content.
15.3 By purchasing the Keep Nomad annual plan subscription, the User agrees to comply with all copyright protection laws applicable to the training content and other content on the platform.
16. Rights over the Content
16.1 The User attests that all content they provide in the members’ area and community of the Keep Nomad platform complies with current copyright and intellectual property laws, and the User is solely responsible for what is published or provided.
16.2 Except as provided in these Terms, no User is allowed to dispose of, modify or commercialize the training content.
17. Intellectual Property Infringement
17.1 The infringement of intellectual property rights, whether to the detriment of Keep Nomad or any third party, may result in the User being banned without refund of any amounts paid.
18. Limitation and Exemption of Liability
18.1 Keep Nomad does not create obligations with the User beyond those expressly described, and not implied, in these Terms of Use and in the Terms of Use of the Keep Nomad platform (https://keepnomad.com/termos-de-uso/).
18.2 The User is aware that by sharing personal or contact information in the members’ area and community, other users may have access to it.
