1. Presentation
1.1 Keep Nomad and all the content it contains are the exclusive property of I.I.C.N.Da Gama Filho, a legal entity governed by private law, registered with the CNPJ under No. 29.237.191/0001-91, with its registered office at Rua Diogo Rodrigues Marques, 353 - São Paulo - SP - 04677-042.
1.2 The rules set out in these Terms of Use deal with the services offered on the www.keepnomad.com website.
1.3 These Terms of Use and Privacy Policy comply with the principles of art. 6 of Law 13.709/2018 - General Data Protection Law and, therefore, correspond to a duty of the controller and a right of the holder of personal data.
1.4 The User does not have the right to copy or record, in whole or in part, the digital content made available, under penalty of incurring a crime of copyright infringement.
1.5 You voluntarily agree that in all circumstances, in relation to the training, made available by Keep Nomad, your rights are limited by copyright and/or intellectual property laws, as set out in the above.
2. User permissions
2.1 By accepting these Terms of Use, the User is granted the non-exclusive, non-transferable, non-sublicensable and limited right to access and use the training, by subscribing to Keep Nomad's annual plan, published on the course sales page (www.keepnomad.com).
2.2 Rights not guaranteed in writing in the Terms are reserved to Keep Nomad
2.3 Access to the training in full is guaranteed via an account registered on the Keep Nomad platform. The account is personal and non-transferable, so it cannot be assigned to anyone other than the buyer under any circumstances.
2.4 The User does not have the right to copy or record, in whole or in part, the digital content made available, under penalty of incurring a crime of copyright infringement.
2.5 You voluntarily agree that in all circumstances, in relation to the training, made available by Keep Nomad, your rights are limited by copyright and/or intellectual property laws, as set out in the above.
3. Description of the service
3.1 Access is complete to the training, as well as to all the content offered to subscribers to Keep Nomad's annual plan.
3.2 The purchase of an annual subscription to Keep Nomad gives the user access to the training and other courses made available to annual subscribers to the Keep Nomad platform.
3.3 Access to the training will be for as long as the user subscribes to Keep Nomad's annual plan.
3.4 The Keep Nomad annual plan subscription can be purchased in the following ways:
a) Payment by Boleto: By opting for this method, a boleto will be generated, from which the total price of the course will be charged for access.
b) Payment by Credit Card: By opting for this method, the User's credit card will be charged the full price of the course.
c) Payment in Installments via Credit Card: By opting for this method, the User's credit card will be registered, and the price for access will be charged in between 2 (two) and 12 (twelve) fixed, equal and successive installments, depending on the User's choice.
d) Payment via Pix: By opting for this method, a code and/or QR Code will be generated, from which the full price of the course will be charged.
4. Promotions
4.1 When it wishes, Keep Nomad will run promotions about the training, with or without its own restrictions, to be run according to the company's interests.
4.2 Your participation in any promotions implies acceptance of their rules.
5. Using the account
5.1 The User agrees that only he/she will use his/her account in the members' area of the Keep Nomad platform, and that he/she will not transfer to a third party and will not share or make available the digital content provided, under penalty of incurring civil and criminal sanctions for violation of Keep Nomad's exclusive copyright.
5.2 The User agrees to notify Keep Nomad through the platform channels in the event of a breach of their account.
5.3 The User is aware and agrees that the data provided at the time of purchase of the Keep Nomad annual subscription will appear on the course purchase invoice.
5.4 The User will have a non-extendable period of 5 (five) days to correct any errors in filling in personal information when purchasing the annual plan subscription on the Keep Nomad platform.
6. Policies and rules
6.1 By accessing the members' area and all Keep Nomad content, including training, the User is subject to all the rules described in these Terms of Use, which may change at any time.
6.2 Keep Nomad monitors activity on its platform. Therefore, a unique system ID may be created in order to guarantee security and prevent fraud.
6.3 The minimum age for purchasing and using the Keep Nomad annual subscription, participating in promotions and offers is 13, and children under 16 must be represented by their parents or legal representative at the time of purchasing the course. Those over 16 and under 18 must be assisted by their parents or legal representative when purchasing the course.
6.4 The User agrees that violating these Terms of Use may result in the User being banned without the right to a refund and/or any rebate or compensation for damages.
6.5 The User agrees that anonymity is forbidden within the Facebook community and that they will provide truthful information for registration if Keep Nomad requests it for a specific need.
6.6 The User agrees that the data provided at the time of registration for the purchase of the Keep Nomad annual plan subscription will appear on the Invoice for the purchase of the subscription and that there will be no possibility of altering the Invoice once it has been issued.
6.7 As access is personal and non-transferable, it is forbidden to encourage others to violate this rule.
6.8 Resale, transfer, exchange and similar activities with regard to training content are expressly prohibited.
6.9 No training content may be transferred, passed on, assigned, marketed, supplied, exhibited for sale, offered, even free of charge, to third parties without the prior express authorization of Keep Nomad.
7. Using training on the Keep Nomad platform
7.1 The rights provided for in these Terms of Use do not guarantee any of the following rights:
a) Enter into agreements with any profit-generating transmission system (terrestrial, satellite, cable and/or other distribution channels);
b) Distribute the didactic content of the training to third parties on other content distribution systems (paid audio applications or audio on demand or similar) or on physical media (Compact Disc, Digital Versatile Disc, semiconductor chips, hard disks, memory cards and similar);
c) Reproduction or promotional use of training content;
d) Distributing or redistributing the didactic content of the training in streaming applications (via the Internet, intranets and/or other networks);
e) Commercial, sales, resale, reproduction, distribution or promotional use of the training content.
7.2 If you are allowed possession or control of training content, it is your responsibility not to lose, damage or destroy it.
8. Reimbursement
8.1 Unless otherwise stated in writing, there will be no refunds and/or cancellations. These Terms of Use, as well as the Terms of Use and Privacy Policy of the Keep Nomad platform, will come into force upon acceptance by the User and confirmation of payment and release of access to the platform.
9. Termination
9.1 Keep Nomad reserves the right to terminate the User's account and prevent their access at any time if any breach of any of the clauses of these Terms of Use is found.
9.2 In the event of termination of the user's account as described above, no fees or expenses will be refundable.
9.3 No charges are refundable. By purchasing access, the user will be able to use it throughout the contracted period.
9.4 Any loss of the User's right of access to the Keep Nomad platform, whether due to cancellation, non-payment of the bank slip, the User's sole fault, among others, will result in the loss of access to any additional features and services, if any.
10. Right of repentance
10.1 In compliance with the Consumer Protection Code, the User may, within 7 (seven) days from the date of purchase, request cancellation by sending an e-mail to [email protected] with a full refund of the amounts paid.
10.2 Keep Nomad will refund any amounts paid within two (2) working days.
10.3 In the case of purchases made by credit card, Keep Nomad will immediately inform the payment gateway in order to reverse the charges, and its effective realization is the sole responsibility of the payment gateway, since Keep Nomad has no control over such procedures.
10.4 Cancellation requests made after the 7 (seven) day period will follow the guidelines set out in the Terms of Use (https://keepnomad.com/termos-de-uso/) of the Keep Nomad platform in item 13 (Cancellation of the annual plan).
11. Credit card payments and transactions
11.1 In order to process payment in the event that you contract a paid Service, we will share your credit card number, bank details, billing details and contact information with financial institutions, payment method providers, payment method integrators and credit card companies.
11.2 When you register your credit card, you may be charged R$1.00 to validate your credit card with your credit card company. The amount charged will be refunded within 72 hours.
11.3 You agree to your credit card being charged all fees and sales taxes and any other expenses you may incur in connection with the use of Keep Nomad.
11.4 All charges will be billed to your credit card, according to the payment method chosen on our platform. Any fees or bank charges arising from the contract dealt with here will be your responsibility.
11.5 Once the contracted annual subscription period has elapsed, the User's access will be automatically renewed. The User agrees to be charged for the renewal, and is responsible for maintaining the necessary funds for payment at the correct time.
11.6 The User agrees that they are responsible for keeping their payment information up to date.
11.7 By providing your credit card information to Keep Nomad, you agree that you will consult the terms and conditions that are imposed by your credit card issuer for notification requirements and limitations on your liability in the event of loss, theft or unauthorized use of your card, as well as information related to the credit limit and use thereof.
11.8 The User agrees that he/she will be solely responsible for payment of all amounts invoiced. The User agrees that they will not provide any credit card information that is not in their name.
12. Privacy
12.1 By registering and purchasing an annual subscription to the Keep Nomad platform, the User agrees to abide by its Terms of Use (https://keepnomad.com/termos-de-uso/).
13. Changing the terms of use
13.1 Keep Nomad may change these Terms of Use at any time. When there are changes, Keep Nomad will notify the User via e-mail, requesting a new expression of agreement to the Terms of Use.
13.2 By continuing to access the contents after communication of the change to the Terms of Use, Keep Nomad understands and considers it as an action of consent to the new published version of the Terms of Use.
14. Digital content
14.1 Any training content may be altered, removed, moved, reorganized, re-recorded, re-edited and merged with other content by Keep Nomad or specifically by any third party it permits.
15. Copyright
15.1 All content made available in the training is protected by applicable copyright laws and treaties.
15.2 Except as provided in the Terms, no user is allowed to dispose of, modify or commercialize the contents of the training.
15.3 By purchasing a subscription to Keep Nomad's annual plan, the User agrees to comply with all copyright protection laws covering the content of the training and other content on the platform.
16. Rights over content
16.1 The User certifies that all content that he provides in the members' area and community of the Keep Nomad platform is in accordance with current copyright and intellectual property laws, and the User is responsible for what is published or provided.
16.2 Except as provided in the Terms, no user is allowed to dispose of, modify or commercialize the contents of the training.
17. Infringement of intellectual property rights
17.1 Infringement of intellectual property rights, whether to the detriment of Keep Nomad or a third party, may result in the User being banned and no refunds being given.
18. Limitation and Disclaimer
18.1 Keep Nomad does not create any obligations with the User other than those expressly described, not implied, in these Terms of Use and in the Terms of Use of the Keep Nomad platform (https://keepnomad.com/termos-de-uso/).
18.2 The User is aware that by sharing personal or contact information in the members' area and community, other users may have access.
